Kristin Cavallari makes startling accusations against estranged husband Jay Cutler amid their divorce.
Days after Cutler filed for divorce on April 21 citing irreconcilable differences, Cavallari filed a response, obtained by TMZ on Monday, listing “inappropriate marital conduct” in addition to “irreconcilable differences” as the grounds for their split.
“The Wife would show onto the Court that the Husband is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper,” Cavallari’s documents state.
Cavallari also preemptively denies any potential accusation of “misconduct” on her part.
“Any misconduct alleged or implied against her in the complaint for divorce was in response to and/or as a result of misconduct on behalf of the Husband,” it stated.
Though Cutler wrote in his documents that he is “the available at home parent and the primary caretaker of the parties’ minor children [sons Camden, 7, and Jaxon, 5, and daughter Saylor, 4],” Cavallari refutes this, claiming, “Wife would show that she has been the primary residential parent.”
The “Very Cavallari” and “Laguna Beach” star is asking for child support and primary physical custody of their kids. She also asks that Cutler pay for their children’s health insurance, as well as a life insurance policy where she is listed as the sole beneficiary.
The former NFL quarterback is requesting joint custody, equitable distribution of their marital assets, and to be awarded “reasonable attorney fees” and “general relief to which he may be entitled.”
While he lists their date of separation as April 21, she lists it as April 7, the day they and their friends returned home from a spring break trip to the Bahamas.
Sunday on Instagram, Cavallari and Cutler released a joint statement on their respective pages announcing the end of their seven-year marriage.

With great sadness, after 10 years together we have come to a loving conclusion to get a divorce. We have nothing but love and respect for one another and are deeply grateful for the years shared, memories made, and the children we are so proud of. This is just the situation of two people growing apart. We ask everyone to respect our privacy as we navigate this difficult time within our family.

That same day, a People source contends that their split had “absolutely nothing to do” with cheating rumors, including that one that alleged Cutler had an affair with Cavallari’s ex-BFF Kelly Henderson.
The insider also claims the two knew they were going to break up prior to their Bahamas trip, which was extended because of canceled flights caused by the coronavirus pandemic.
“On their recent trip, they already knew they were splitting up,” the source told the outlet. “The reason they announced it now is because it’s a quiet time for them to work through all of this and try to move forward.”
As for the reason for their split, the source claims, “Kristin and Jay are a lot different.”
“She has so much on her plate, with her brands and with the show,” the insider explained, adding, “Jay is not as interested in all of that. She’s so passionate about her work and they couldn’t relate to each other as much. So it pulled them apart.”
The two married in June 2013.
